Please read these Terms carefully before you start using the website. By visiting this website at www.kellnerfoundation.cz (hereinafter “the Website”), and/or by starting to use it, you agree with the Terms as set out in the following regardless of whether or not you are a registered user.

This Website is owned and operated by Nadace THE KELLNER FAMILY FOUNDATION, having its registered office at Praha 6 - Dejvice, Evropská 2690/17, postal code 160 41, Czech Republic, incorporated in the Register of Foundations maintained by the Municipal Court in Prague, Section N, File 746, Reg. No. [IČ]: 28902254 (hereinafter “the Foundation”). All material on this Website, including text, website design, logos, and graphics, all illustrations on this Website, and the selection and arrangement of the files contained on this Website (hereinafter “the Content”) enjoys protection under Act No. 121/2000 on Copyright And Rights Incidental To Copyright And On Amendments To Certain Laws (the Copyright Act), as amended (hereinafter “the Copyright Act”). Solely the Foundation is authorized to exercise proprietary copyright to the Content and the Website.

Website use

In using the Website, every user hereof shall observe the applicable legislation of the Czech Republic, shall always act in compliance with such legislation, good morals, and these Terms, and shall refrain from damaging the good name of the Foundation and of the other users in any manner whatsoever.

Without the Foundation’s prior consent in writing, it is prohibited to use the Website and the Content (both as a whole and the various parts of the Website and the Content) for anything other than personal use. Primarily, it is prohibited to change, copy, download or otherwise distribute the Content of the Website in any manner whatsoever. Any use of the Website, including the Content (with the exception of the first sentence of this provision) shall be subject to the Foundation’s prior approval under the Copyright Act. Access to and use of the Website is free of charge.

The following is expressly prohibited:

  • Reengineering the Website in any manner whatsoever;
  • Interfering with the Website’s Content in any manner whatsoever; solely the Foundation has the right to decide on changes and removal of and additions to any part of the Content of the Website;
  • Interfering with the security of the Website in any manner whatsoever or abusing the same in any other way;
  • Using the Website for distributing unsolicited messages (spam) and chain messages;
  • Sending messages containing viruses or any other dangerous or harmful programs to the Website;
  • Creating false messages for the purpose of falsifying the sender’s identity;
  • Attempting to gain access to the Website pages that are excluded from public use;
  • Distributing on the Website any messages or material violating the legislation of the Czech Republic, in particular, but without limitation, messages and material that infringe on third party rights and vested interests, that are against human dignity, the content of which is discriminatory in any manner in terms of religion, confession of faith, race, or sex, and that promote illegal activity or violence.

Trademarks and logos

The Website may contain the Foundation’s logos or logos of other entities, in particular the Foundation’s partners. The Website users do not hold any rights whatsoever to these objects of intellectual property. The Website users may not dispose of these objects of intellectual property in any way without the Foundation’s prior consent. The use of the Foundation’s logo shall always be subject to approval by the Foundation. Even if consent to the use of the Foundation’s logo is granted, users agree to refrain from modifying, transforming or otherwise interfering with the logo in any manner whatsoever (see the document on licenses below).

Limited liability

The information posted on this Website is intended for the public. All information posted on this Website is indicative only and is intended for general use. The Foundation draws some of the information posted on the Website from other sources that it regards as trustworthy. Notwithstanding the foregoing, in no case shall the Foundation be held liable for the accuracy or currency of the information posted hereon.

The Foundation makes its best effort to ensure that the information published on this Website is reliable and accurate; however, technical and typographical errors may occur. These may be corrected upon the identification thereof and at the Foundation’s discretion.

The Foundation shall not be held liable for any damage that users may suffer in connection with their use of the Website.

Links

The Foundation shall not be held liable for any advertisements and/or other forms of promotion performed by any third party through the Website. Further, the Foundation shall not be held liable for the content of third party www pages that can be visited through the Website.

Change of the Content

The Foundation has the right to change the Content and its extent, or discontinue the operation of the Website at any time without notice.

Use of cookies

“Cookies” are information that is transferred from an internet website to the hard disk of the user’s computer. Cookies help a website remember important information that makes it easier for the users to use this particular website again.

The Website employs cookies to adjust these web pages to the users’ needs. Final provisions

With the exception of these Terms and the licenses on the use of the Foundation’s logos and the use of photographs directly intended for use by third parties, the publication of any data or information on the Website does not have the nature of a legal act directed towards the origination of a legal relationship between the Foundation and the internet user, unless specified otherwise in individual cases.

These Terms are subject to the applicable legislation of the Czech Republic. Any disputes that may arise in connection with the use of the Website and the Content shall be heard in the Czech Republic by a court with local jurisdiction in accordance with the laws of the Czech Republic.

Solely the Foundation is authorized to change or amend these Terms. The legal relationships that came into existence between the Foundation and a user of this Website prior to a change or revocation of these Terms shall be governed by the wording of these Terms effective as on the day of the coming into existence of such relationships. The Terms of the use of the Website become valid and come into effect on the day of their publication. These Terms were published on August 13, 2015.

These Terms were produced in the English and Czech languages simultaneously. In the event of a discrepancy between the Czech and English texts of the Terms the Czech text of the Terms shall apply.

Data protection

Nadace THE KELLNER FAMILY FOUNDATION, having its registered office at Praha 6, Dejvice, Evropská 2690/17, postal code 160 41, Czech Republic, registered in the Register of Foundations maintained by the Municipal Court in Prague, Section N, File 746, Reg. No. [IČ]: 28902254 (hereinafter “the Foundation”), respects the privacy of the users of www.kellnerfoundation.cz (hereinafter “the Website”). The Foundation only collects the personally identifiable data (such as name, address, and e-mail address) that the users themselves provide to the Foundation on a voluntary basis. The Foundation shall only use this data for the purpose for which such data has been provided. From time to time, such data can be used for the Foundation’s communication with users with a view to better providing for the users’ needs.

However, the Foundation does not rule out that access to certain parts of the Website or access for obtaining some specific Content of the Website may be conditional on providing certain personal data within the meaning of Act No. 101/2000 on Personal Data Protection, as amended, and, if applicable, also other laws. In such a case, the Foundation undertakes to treat the user-provided personal data in compliance with Act No. 101/2000, on Personal Data Protection, as amended, and other regulations.

In connection with the collection, if any, of personal data as above indicated, the Foundation undertakes to safeguard the personal data provided to it and to protect the personal data against unauthorized third party interference, abuse, divestiture, theft, and publication. The provided personal data shall be collected on a computer server in a monitored and protected environment supported by modern hardware and software.

However, the Foundation would like to point out that where the access to certain parts of the Website or access for obtaining some specific Content of the Website is conditional on providing certain personal data within the meaning of Act No. 101/2000 on Personal Data Protection, as amended, and, if applicable, also other laws, this will result in the Foundation processing such data. In this sense, the Foundation would like to point out that, in accordance with the above Personal Data Protection Act, you can request access to your personal data processed by the Foundation at any time and request that it be corrected, and also request that the Foundation discontinue processing your personal data at any time. In connection with your request for the Foundation to discontinue processing your personal data, the Foundation would also like to point out that once the processing of your personal data has been discontinued you will be denied access to the respective parts of the website or denied the opportunity to obtain specific website content.

At your written request, the Foundation will also give you information on your rights and other relevant information on the processing of your personal data in connection with accessing and using the website.

Licenses

Nadace THE KELLNER FAMILY FOUNDATION, having its registered office at Praha 6, Dejvice, Evropská 2690/17, postal code 160 41, Czech Republic, registered in the Register of Foundations maintained by the Municipal Court in Prague, Section N, File 746, Reg. No. [IČ]: 28902254 (hereinafter “the Foundation”), offers the Foundation’s official and project logos in color and black-and-white renditions for downloading (free of charge) on the Foundation’s website at www.kellnerfoundation.cz (hereinafter “the Website”). For the purpose of these licenses, the Foundation’s official and project logos are collectively referred to as “the Foundation’s Logo”. The Foundation also offers users for downloading (free of charge) the photographs that are intended by the Foundation for downloading on the Website. For the purposes of these licenses, the photographs intended by the Foundation for downloading are collectively referred to as “the Photographs”.

The Foundation’s Logo and Photographs, and all the other material posted in any part of the Website (including text, Website design, and graphics, all illustrations on this Website, and the selection and arrangement of the files contained in this Website), hereinafter “the Content”, enjoy protection under Act No. 121/2000 on Copyright And Rights Incidental To Copyright And On Amendments To Certain Laws (the Copyright Act), as amended (hereinafter “the Copyright Act”). Solely the Foundation is authorized to exercise proprietary copyright to the Foundation’s Logo, Photographs, and the Content, and to the Website.

Should you wish to download and use any of the Foundation’s Logos and/or any of the Photographs, please obtain a prior consent in writing from the Foundation. It is hereby expressly laid down, and by expressing your consent to these licenses you acknowledge, that you are not authorized to use any of the Foundation’s Logos or Photographs in any manner whatsoever without the Foundation’s written consent thereto.

For obtaining consent to the use of the Foundation’s Logo or Photographs, please fill out the electronic form “Request” [Žádost]. Please state the purpose, extent and time for which you wish to use the Foundation’s Logo or Photographs in the request. With regard to the purpose and time for which you specify the use of the Foundation’s Logo or Photographs in the request, the Foundation will decide, at its sole discretion, whether or not your request will be granted and you will be allowed to use the Foundation’s Logo or Photographs. To obtain consent to the use of the Foundation’s Logo or Photographs you must state only true and complete information in the request. If your request is approved you will be allowed to download the Foundation’s Logo and/or Photograph and use the same for the purpose stated in the request.

In no case do you become the owner of the Foundation’s Logo or Photographs by downloading the same. The Foundation’s Logo and Photographs may only be used for the purpose and to the extent stated by you in the request that was approved by the Foundation. In no case are you authorized to dispose of the Foundation’s Logo or Photographs arbitrarily. The user who was allowed to download the Foundation’s Logo or Photographs undertakes to use the Foundation’s Logo or Photographs only for the purpose and to the extent for which the downloading and use of the Foundation’s Logo or Photographs was permitted, and only once.

For the purposes of avoiding any and all doubt it is hereby agreed that unless the Foundation expressly stipulates otherwise, in particular the following is prohibited, without limitation:

  • To hand over, sell, or otherwise provide the Foundation’s Logo and/or Photographs to a third party for use or to make the same available to a third party in any manner whatsoever;
  • To create copies of the Foundation’s Logo and/or of Photographs;
  • To use the Foundation’s Logo and/or Photographs for any purpose other than for which the Foundation has granted authorization;
  • To use the Foundation’s Logo and/or Photographs to an extent other than for which the Foundation has granted authorization;
  • To reproduce, adapt, alter or otherwise interfere with the Foundation’s Logo or Photographs;
  • To include the Foundation’s Logo or Photographs in materials, or combine the Foundation’s Logo or Photographs with works and/or materials, that are in breach of Czech law or good morals or pose threat to public order or the content of which does not match the Foundation’s interests or intentions, with deceptive or untrue news or materials, with materials that infringe on the rights and vested interests of the founders of the Foundation or other third parties, or with materials that are against human dignity and/or the content of which is discriminatory in terms of religion, race, or sex and/or that promote violence or any other illegal behavior.

In the event of a breach of any of the above points you acknowledge that:

  • Such use of the Foundation’s Logo can be regarded as damaging the Foundation’s rights and vested interests and in such a case the Foundation shall have the right to use all the ways and means available to it under applicable law for the protection of the Foundation’s rights and vested interests;
  • Such use of the Photographs can be regarded as damaging the Foundation’s rights and vested interests and can further be regarded as unauthorized interference with the personal rights of the individual depicted on the Photographs, as provided for in Section 81 et seq. of Act No. 89/2012, the Civil Code, as amended. In such a case, each and every individual depicted in the Photographs shall have the right to use all the ways and means available to them under applicable law for protection against unauthorized interferences with the personal rights of such an individual, including those available under criminal law.

Should you want to combine the Foundation’s Logo and/or Photographs with an author’s work (literary or artistic), the Foundation reserves the right to request you to submit the author’s work in question for approval by the Foundation.

In using the Foundation’s Logo, you shall be obliged to use the same solely in compliance with the visual presentation manual, the downloading of which will be made possible for you by the Foundation. At the same time, the Foundation reserves the right to request the submission of the graphic design of each material on which the Foundation’s Logo is to be shown. In the event of a breach of this provision the Foundation shall have the right to proceed as described above.

You shall be obliged, and hereby agree, to remove the Foundation’s Logo and/or each and every Photograph from the recording medium on which you stored the Foundation’s Logo and/or the Photographs after having used the Foundation’s Logo and/or the Photographs.

Should you wish to use the Foundation’s Logo and/or the Photographs on behalf of your employer, you hereby state, thereby pledging the same, that you are authorized to accept these licenses on behalf of your employer.

Solely the Foundation is authorized to change or amend these licenses. The legal relationships that came into existence between the Foundation and a user of the Foundation’s Logo or the Photographs prior to a change or revocation of these licenses shall be governed by the wording hereof effective as on the day of the coming into existence of such relationships.

These licenses are governed by the applicable Czech laws. Any disputes that may arise in connection with the use of the Foundation’s Logo and/or Photographs shall be heard in the Czech Republic by a court with local jurisdiction in accordance with the laws of the Czech Republic.

These licenses are valid and effective as of the day of publication. These licenses were published on August 13, 2015.

These licenses have been produced in the English and Czech languages at the same time. In the event of a discrepancy between the Czech and English texts the Czech text shall apply.
